1. This petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita,2023 seeking a Writ in the nature of Habeas Corpus for the production of Ms. Nisha Thakur, claimed to be the wife of the petitioner herein.
2. Pursuant to our directions, Ms. Nisha Thakur has appeared before us physically. She has informed us that out of her own free will and volition, she has married a person namely, Pradeep (respondent no. 5 herein) and is happily staying with him. She also denies having married the petitioner. She maintains that the petitioner is, in fact, the husband of her deceased sister.
3. On the other hand, the petitioner maintains that Ms. Nisha is his legally wedded wife. Even though he claims that her marriage with Mr. Pradeep would, therefore, be illegal, these are not the matters, being disputed questions of facts, to be determined by this Court in This is a digitally signed order.
