The present petition alleges wilful disobedience / non-compliance of the directions contained in the judgment / order dated 04.08.2021 passed in W.P.(C) 132/2021. The operative directions therein reads as under: “31. In view of my above discussion, the impugned result notice dated December 24, 2020, insofar as the selection of the respondent Nos.3 to 12 is concerned, the same is held as illegal. The selection of the respondent Nos.3 to 12 is set aside. Consequently, their appointments are also set aside. The respondent No.1 is within its right to prepare a fresh selection list for filling up the ten posts / vacancies which now arise in view of this order, as per the selection criteria evolved by it and then proceed accordingly. The writ petition with regard to respondent Nos.13 to 17 is dismissed.” 2. Learned counsel for the petitioners submits that the aforesaid directions have not been complied with despite the fact that challenge to the aforesaid judgment / order stands dismissed by the Supreme Court. In terms of the advertisement, selection process for the post of Assistant Director (Technical) was through a Computer-Based Test (‘CBT’ for short) followed by written examination and interview. The CBT was held on July 24, 2019. Similarly, the written examination was held on October 10, 2020. A communication notice was published on November 10, 2020 by the respondent No.1 publishing provisionally list of successful candidates who were to be called for interview. The respondent No.1 conducted interview for 75 candidates. The result for the same was published on December 24, 2020, wherein the names of respondent Nos.3 to 12 also features, and accordingly, they have been issued appointment letters to the post of Assistant Director (Technical).” 4. It is pointed out that a list of 75 persons was drawn for a Computer- Based Test (CBT), followed by a written examination and interview. This was taken note of in the aforementioned para-3 of the judgment / order dated 04.08.2021. 5. Attention is also drawn to a copy of the notice dated 10.11.2020, which is also referred to in para-3 of the aforesaid the judgment / order dated 04.08.2021. Learned counsel for the petitioners contends that the fresh selection list is to be drawn up from the aforementioned list of 75 persons for the purpose of complying with the directions contained in the judgment/ order dated 04.08.2021. 7. Mr. Aditya Singla, learned counsel for the respondents, on instructions, does not refute that fresh selection list is to be drawn up from the pool of 75 persons, referred to in the aforementioned notice dated 10.11.2020. He however, submits that the concerned department would need some time for the purpose of completion of all the formalities in this regard. He assures and undertakes that necessary compliance shall be done latest within a period of three months from today and a fresh selection list shall be This is a digitally signed order.
