The present writ petition has been filed seeking the following reliefs: “a) Issue a writ of mandamus or any other appropriate writ/direction of similar nature directing Respondent No. 1 (MCD) to immediately remove all encroachments, cooking equipment, gas cylinders, water tank, tents and materials from Public Street/Road No. 41, Punjabi Bagh West, Public Park and pavement abutting the same and restore the road to its original unobstructed condition; and b) Direct Respondent Nos. 1 to 4 to forthwith prohibit Respondent No. 5 and/or any other persons from organizing or conducting any langar or similar activity on the said public street without lawful permission/authorization; and c) Direct Respondent Nos. 3 and 4 (Police Authorities) to take appropriate preventive and penal action against the offenders in accordance with law as to abate the public nuisance and ensure safety and security of residents including the petitioners;” 2. The present petition has been filed by eleven (11) petitioners, who are stated to be residents of Punjabi Bagh (West). The grievance of the petitioners is that right opposite to their houses, the respondent no.4 has been conducting daily Langar activity on public street, without any permission from the Municipal Authorities, thereby causing nuisance outside the petitioners’ residences. 3. It is submitted on behalf of the petitioners that the cooking activities also take place on the said public street. This is a digitally signed order. A status report has been filed on behalf of respondent no.1/ MCD, wherein it is stated that the temporary encroachment on the pavement at the site in question has been removed on 1st April, 2026. 4.1. Photographs have been filed along with the status report to show that the encroachment has been completely removed. 5. It is also stated in the said report that a letter has been issued to the respondent no.3/ SHO, P.S. Punjabi Bagh (West) to keep a strict vigil in the area where the temporary encroachments have been removed, so that encroachments do not occur in the future. 6. Counsel appearing on behalf of the respondent no. 3/ SHO, P.S. Punjabi Bagh (West) submits that Police force have been deployed so that no encroachment is carried out in future. 7. Mr. Abhijat, Senior Counsel appearing on behalf of Shri Sewaram, private respondent no.4 herein, submits that the langar was being distributed by respondent no.4 purely as a charitable measure from 7:00 AM to 9:00 AM. 8. Considering the submissions made on behalf of the official respondents i.e., MCD and SHO, P.S. Punjabi Bagh (West), the grievance of the petitioners stands redressed. 9. Accordingly, the petition is disposed of, while directing the respondent no.1/ MCD as well as the respondent no.3/ SHO, P.S. Punjabi Bagh (West) to ensure that no encroachment, temporary or permanent, occurs in the subject area in future. 10. Respondent no.4, who is present in Court, undertakes that he shall not carry out any activity which causes public nuisance or is in the nature of an encroachment on a pavement.
