Dei, learned counsel was appointed as amicus curiae by this Court to conduct the appeal on behalf of the appellant as there was no appearance on behalf of the appellant and he could not be contacted by the CBI. Ms. Dei, learned counsel is the counsel for Karunakar Bugdei, appellant in the connected appeal- CRA No. 274 of 1996, which is listed with this appeal. 2. On 21.02.2023, Mr. S. Nayak, learned counsel for the CBI submitted before the Court that the appellant- Manmohan Rout had already expired and the appellant- Karunakar Bugdei, appellant in the connected matter- CRA No. 274 of 1996 had been served notice to appear in this case and that he will produce the written instruction on the next date. It appears that the CBI never submitted the written instructions. 3. Mr. Sarthak Nayak, learned Special Public Prosecutor-cum- Retainer Counsel (CBI) states that Manmohan Rout was also an appellant in Criminal Appeal No. 205 of 1997. As he could not be contacted despite several attempts, this Court has disposed of that appeal treating the same as abated on 23.02.2022. It appears that this order has not been recalled or modified subsequently. 4.
