The appellant-State through instant appeal is seeking setting aside of award dated 12.10.1993 whereby learned Additional District Judge, Patiala (hereinafter to be referred to as ‘Reference Court’) has enhanced amount of compensation awarded by Land Acquisition Collector (for short ‘Collector’). 2. The appeal is confined to severance charges which were awarded by the Collector vide award dated 26.03.1988. The Reference Court has awarded severance charges @ 60% of the market value. The State is claiming that severance charges could not be more than 50% of market value. 3. On being asked, learned State counsel is unable to point out amount of market value which was assessed by the Reference Court or Collector. 4. Heard the arguments and perused the record. 5. Considering the period & amount involved and the fact that awarded amount must have been released, this Court finds it appropriate to MOHIT KUMAR 2026.07.23 14:05 I attest to the accuracy and authenticity of this order/judgment. The State is at liberty to move an appropriate application within one year from today, if it is found that substantial liability is involved.
