Criminal Appeal No. S-1993 of 2026 3 custodial interrogation is not required. 7. The record has been perused carefully. 8. A perusal of record shows that while passing the interim order dated 03.07.2026 following observations were recorded:-
“With regard to benefit of anticipatory bail, in a case pertaining to an offence under Section 3 of SC/ST Act, the Hon’ble Supreme Court of India in the case of ‘Deepak Kumar Tala V/s State of Andhra Pradesh & Ors.’, 2025(2) RCR (Criminal) 440, has observed that the anticipatory bail can be granted in a case, wherein essential ingredient of public view for caste-related insult was not prima facilely established. This Court while dealing with a similar situation in the case of ‘Vijay Sharma V/s State of Punjab’ CRM-M-27136-2022, has observed that anticipatory bail under Section 438 of CrPC can be granted where ex facie ingredient of the offence under SC/ST Act is not made.
If the facts and circumstances of the present case are analyzed in the light of above-mentioned principles of law, it transpires that in the present case, there exists a reasonable doubt as to whether the caste slur was in public view or not, and secondly, as to whether the word abusive in the name of caste of complainant were uttered by the petitioner or somebody else. Qua both the abovementioned components, the FIR is vague. Thus, it is hereby observed that, in view of factual matrix of the present case, the bar of Section 18 of SC/ST Act is not attracted in the present case. In addition to above, following are the relevant factors which are required to be taken into consideration for a decision:- i. that nothing has to be recovered from the possession of appellant;

9. Keeping in view the aforesaid facts and circumstances, along with legal position, and the fact that the appellant has already joined the investigation, it is hereby ordered that the appellant is entitled to anticipatory bail.
