This is a Civil Writ Petition filed under Article 226 of the Constitution of India for the issuance of a writ in the nature of certiorari for quashing of impugned letters (Annexures P-7 and P-8) and for issuance of a writ in the nature of mandamus directing respondent No.4 to go ahead with the consolidation proceedings. 2. On 22.09.1992, a Coordinate Division Bench of this Court was pleased to pass the following order:- “Mr. V.K. Jain, Sr. Advocate with Mr. N.K. Jain, Advocate. .. PAWAN KUMAR 2026.07.14 09:38 I attest to the accuracy and authenticity of this document CWP-12868-1992 (O&M) [2] Notice of motion for 4.11.1992. Further proceedings in pursuance of order Annexure P- 7 and P-8 are stayed. 22.9.1992” 3. Thereafter, on 25.09.2003, a Coordinate Division Bench of this Court had passed the following order:- “Present: None for the applicants. -- We have gone through the averments contained in the application and are of the opinion that C.W.P. No. 12868 of 1992 deserves to be heard only after the decision of R.S.A. No. 1936 of 1987. Hence, the prayer for hearing of the writ petition along with R.S.A. No. 1936 of 1987 is rejected. The writ petition be listed for hearing after the decision of the said Regular Second Appeal. The C.M. is disposed of accordingly. 25.9.2003” 4. On 04.02.2026, a Coordinate Division Bench of this Court had passed the following order:- “Present: Mr. Veer Imaan Singh Gill, Advocate for the petitioners. Mr. Saurabh Mago, DAG, Haryana. * * * Learned counsel for the parties submit that RSA-1936- 1987 is pending for final decision. To await the final decision in the aforesaid appeal, hearing of the present petition is deferred to 13.07.2026. 04.02.2026” 5. It has been jointly stated that the said RSA is still pending. It is PAWAN KUMAR 2026.07.14 09:38 I attest to the accuracy and authenticity of this document CWP-12868-1992 (O&M) [3] further jointly submitted that the present writ petition be disposed of at this stage but liberty be granted to all the parties to revive the same after decision in the said R.S.A. No.1936 of 1987 in case any cause survives or in case any other subsequent events occur. It is further stated that the interim order dated 22.09.1992 be continued till the time the RSA is decided. 6. Keeping in view the abovesaid facts and circumstances and fair stand taken on behalf of the petitioners and the respondents, the present writ petition is disposed of at this stage with liberty to all the parties to revive the present writ petition after decision in R.S.A. No.1936 of 1987 in case any cause survives or in case any cause arises in future. 7. Interim order dated 22.09.1992 would continue to operate unless on an application for revival in the abovesaid circumstance, same is modified or vacated. 8. The passing of the present order should not be construed as an expression of opinion on the merits of Regular Second Appeal which would be argued and decided independently.
