GP FOR SCHOOL EDUCATION The Court made the following: 3 CMR,J & GTK,J W.P.No.1992 of 2026 The Court made the following: ORDER: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy) Heard Sri M.Sohail Shareef, learned counsel representing Sri Kaleemulla S, learned counsel for the petitioners and learned Government Pleader for Services-III appearing for respondents. 2. The Writ Petition is filed to declare the inaction of the respondents in reinstating the petitioners into service in the post of Secondary Grade Teacher (Telugu Medium) in compliance with the common order of the Andhra Pradesh State Administrative Tribunal, Hyderabad dated 03.08.2012 passed in O.A.No.6965 of 2011 and batch as illegal and consequently sought direction to the respondents to implement the order of the Tribunal and reinstate the petitioners into service in the above post. 3. The petitioners are employees working as Secondary Grade Teachers (Telugu Medium). They were removed from the service on the ground that they have produced fake study certificate and nativity certificate. Petitioners have challenged the said order of removal from service before the Andhra Pradesh State Administrative Tribunal. The Tribunal by an order dated 03.08.2012 allowed the O.A.No.6965 of 2011 filed by them and ordered for their reinstatement. 4. The State has challenged the said order of the Tribunal before this Court. A Coordinate Bench of this Court, by order dated 25.04.2025 passed in W.P.No.4762 of 2021 and batch, dismissed the said writ petition confirming the order of the Tribunal to reinstate the petitioners into service. 5. Learned Government Pleader for Services III submits that as there was an order of stay passed by a Coordinate Bench of this Court in W.P.No.4762 of 2021 and batch preferred by the State that the order of the Tribunal is not implemented and as the said writ petition preferred by the State was dismissed that the State will now implement the order of the Tribunal and 4 CMR,J & GTK,J W.P.No.1992 of 2026 reinstate the petitioners into service within the time stipulated by this Court. He prayed to grant reasonable time to implement the order of the Tribunal. 6. Therefore, the Writ Petition is allowed directing the respondents to implement the order of the Andhra Pradesh Administrative Tribunal dated 03.08.2012 passed in O.A.No.6965 of 2011 and batch which in turn was confirmed by this Court in W.P.No.4762 of 2021 and batch as per order dated 25.04.2025 within a period of three (03) months from the date of this order, failing which the respondents have to face the legal consequences for non compliance of the order of the Court. There shall be no order as to costs.
