On account of death of Raj Kumar in a Motor Vehicular Accident, his family members filed a claim petition under Section 166 of the Motor Vehicles Act, 1988 seeking compensation from the driver, owner and insurer of the offending vehicle. The Tribunal has awarded an amount of Rs. 14,84,856/- and held the respondents liable to pay the said amount jointly and severally along with interest. 2. Assailing the award on the aspect of quantum of compensation, it is argued by learned counsel that deceased was a milk vendor and was running a dairy business and therefore, his income should not be considered as that of the unskilled labourer. Learned counsel submits that a photocopy of milk dairy register was produced as Ex.P-1 before the Tribunal by the widow of the deceased. 3. However, on specific query, it is conceded by learned counsel that the said milk dairy register was not proved by establishing whether it was in the handwriting or under the signature of the deceased. Apart from this, as per the findings by the Tribunal, nobody was examined as to whom the deceased ever KUMARI SAPNA 2026.07.15 18.13 I attest to the accuracy and integrity of this document FAO-1987-2026 (O&M) 2 supplied the milk. There was no evidence that the deceased had any income in his name and it is because of this reason that Tribunal was left with no option but to take the minimum wages payable to unskilled labourer as the notional income of the deceased. 4. This Court does not find any illegality and infirmity in the aforesaid approach as adopted by the Tribunal. No merits. Dismissed.
