The Petitioner is seeking direction by way of issuance of a ‘Writ of Mandamus’ to the Respondents to consider and promote the Petitioner against the post of Assistant Account Officer (Pay Level-7) in tune with the Jammu & Kashmir Academy of Art, Culture and Languages Recruitment Rules, 2007 from the date the post or vacancy became available, along with all consequential benefits. 03. The grievance of the Petitioner is that, despite the vacancy is available, he has not been promoted since 2006 and now he is at the verge of retirement. It is further urged that despite representation in this regard being submitted by the Petitioner, but, till date, same is awaiting consideration at the end of the Respondents. 04. Keeping in view the prayer made in this Petition, coupled with submissions made at the Bar, this Petition is taken on Board for final hearing and is disposed of with a direction to the Respondents to consider the Writ Petition as representation on behalf of the Petitioner and accord consideration to the case of the Petitioner projected therein, particularly keeping in view the treatment accorded to the similarly situated employees of the Department. Let this exercise be completed by the Respondents expeditiously, preferably within a period of eight weeks from the date of receipt of certified copy of this Order, along with Writ Petition and all its annexures. 05. Writ Petition is, thus, disposed of on the above terms, along with the connected CM.
