ORDER(ORAL) 1) The petitioner, through the medium of present petition, has challenged Public Notice No.CDPO/POSHAN/Estt/T/ 2026/399-404 dated 03.08.2026, whereby the candidates, who had applied for the post of Anganwadi Worker for Anganwadi Centre, Dar Mohalla, Larkipora, pursuant to Advertisement Notice dated 25.08.2014, have been asked to submit their original documents along with self-attested photocopies for verification. 2) The grievance of the petitioner is that respondent No.5, who figures at serial No.5 of the aforesaid notice, is not eligible to participate in the selection process. It has been contended that if the official respondents would proceed to finalize the selection process, her writ petition bearing WP(C) No.3165/2025 would become infructuous. WP(C) No.1984/2026
3) Heard and considered. 4) It appears that in the previous round of litigation between the petitioner and the private respondent vide SWP No.789/2015, a direction came to be issued by this Court on 17.09.2015 to Additional Deputy Commissioner, Pulwama, to hold an enquiry into the matter and find out whether the petitioner herein and the private respondent are the residents of Dar Mohalla, Larkipora i.e. hamlet/habitation where the Anganwadi Centre in question is located. 5) Pursuant to the aforesaid direction of this Court, the Additional Deputy Commissioner, Pulwama, furnished his report dated 19.01.2016, whereby he concluded that neither the petitioner herein nor the private respondent is a resident of Dar Mohalla, where the Anganwadi Centre is located. 6) After the submission of aforesaid report, the petitioner herein, apprehending her disengagement, filed a writ petition bearing SWP No.118/2016 before this Court. The said writ petition came to be dismissed in terms of order dated 08.05.2025. The petitioner challenged the said order by way of appeal bearing LPA No.118/2025. The Division Bench, while refusing to set aside the judgment of the Writ Court, gave liberty to the petitioner to challenge the order of her disengagement by way of a fresh writ petition. 7) It seems that the petitioner has filed fresh writ petition bearing WP(C) No.3165/2025, in which notice has been issued to the respondents but no interim protection has been granted in favour of the petitioner.
8) Instead of pursuing the aforesaid writ petition bearing WP(C) No.3165/2025 for obtaining an interim protection in her favour, the petitioner has filed the instant writ petition to seek a relief which she has not been able to get so far in the interim application filed along with WP(C) No.3165/2025. If at all the petitioner has any case, it is open to her to file a fresh interim application in WP(C) No.3165/2025 but she cannot multiply the cases by filing present writ petition for challenging the selection process, in respect of which no restraint order has been granted by the Court in WP(C) No.3165/2025. 9) For the foregoing reasons, the petition lacks merit and is dismissed accordingly, leaving it open to the petitioner to file a fresh interim application in WP(C) No.3165/2025 or to press the interim application which she has already filed in the said writ petition (Sanjay Dhar) Judge
