The instant application has been filed for condonation of delay in filing the appeal. It has been stated in the application that the impugned judgment and decree was passed by the learned District Judge, Kullu on 15.07.2025. The certified copy of the judgment was applied on 23.07.2025 and the same was delivered on 21.08.2025. After obtaining the certified copy, the same was forwarded to the Head Office of the applicant at Dharmshala. The Law Branch of the applicant asked the applicant to provide the entire record of the appeal. The applicant provided the entire record of the appeal and thereafter the opinion was taken by the Head Office to file the appeal. Therefore, it has been prayed that the delay in filing the appeal is neither intentional nor willful, but the same has occurred due to unavoidable circumstances.
Learned counsel for the non-applicants have no objection in case the application is allowed.
Consequently, in view of the averments as made in the application, which is duly supported by an
affidavit and in view of submissions as made by learned counsel for the applicant, the present application is allowed and the delay in filing the appeal is condoned.
Accordingly, the application stands disposed of.
