The present petition has been filed under Article 227 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking the following relief: “Pass the Direction for Expeditious and Time Bound Disposal of the application filed under Section 175 (3) Of BNSS, 2023 in Case titled as Manpreet Singh Vs Arijit Singh,Ct Case No. 1724/2025, which is pending before the Court of Ms Moksha Bains, Ld., JMFC-11, Tis Hazari Courts, This is a digitally signed order. Learned counsel for the Petitioner submits that the application filed under Section 175(3) of the BNSS (corresponding to Section 156(3) of the Code of Criminal Procedure, 1973) has been pending before the learned Trial Court for more than seven months and, despite the Action Taken Report (ATR) having been filed on 15.01.2026, the said application has not yet been decided. 5. Issue Notice. 6. Notice is accepted by the learned ASC for the State, who submits that the ATR was filed before the learned Trial Court on 15.01.2026. 7. Since the ATR already stands filed, it is directed that the learned Trial Court shall decide the application under Section 175(3) of the BNSS in CT Case No. 1724/2025, pending before it, as expeditiously as possible and preferably within a period of six months from the date of receipt of this order. 8. With the aforesaid directions, the present petition is disposed of. Pending application(s), if any, stands disposed of. 9. The order be uploaded on the website forthwith.
