JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER( ORAL) 27.02.2026 1. The matter is taken out of turn at the request of learned counsel for the petitioner. 2. Petitioner, through the medium of the instant writ petition, has drawn the attention of this Court to the order passed by this Court on 17.11.2025, by virtue of which an application bearing No. 6969/2025 preferred by learned counsel for the petitioner was allowed and the documents accompanying the said application, pertaining to the completion certificate, were taken on record. Learned counsel for the petitioner has further drawn the attention WP(C) No. 1980/2022 __________ of this Court to the said completion certificate placed on record along with the aforesaid application, a perusal whereof reveals that the works allotted to the petitioner vide allotment orders dated 14.10.2017, 07.0.2018 and 19.03.2019 have been executed by him and already completed satisfactorily under the close supervision of the Engineering Wing of the Relief Organization. 3. The completion certificate placed on record in the instant petition has been issued by the office of the Relief and Rehabilitation Commissioner, Jammu, and signed by the Assistant Executive Engineer, Relief Organization, Jammu and the Executive Engineer, Relief Organization, Jammu. From a bare perusal of the aforesaid completion certificate, it can safely be concluded that the petitioner has executed the works satisfactorily on the strength of the aforesaid allotment orders and as per the said certificate, an amount of Rs. 27.41 lacs is admitted to be payable to the petitioner for execution of different works. 4. In light of the aforesaid facts, wherein the respondents have already admitted that the petitioner has completed the works satisfactorily, no fruitful purpose would be served in keeping this petition pending. 5. Accordingly, this Court deems it proper to dispose of the instant writ petition with a direction to respondent Nos. 1, 2 and 3 to accord consideration to the case of the petitioner for release of the admitted liabilities reflected in the aforesaid completion certificate, strictly in terms of the law laid down by this Court in case titled “M/s Soldier Construction through Attorney Holder Ghulam Mohammad WP(C) No. 1980/2022 __________ Malik vs. UT of J&K and others” in WP(C) No. 2648/2025 decided on 29.09.2025. 6. The order of consideration shall be passed within a period of four weeks from the date a copy of this order along with a copy of the writ petition and its annexures is made available to respondent No. 2. 7. Needless to say, in case the respondents intend to hear the petitioner, the same shall be done by notifying him in advance, in which eventuality the petitioner may provide the requisite documents which could advance his case for release of the said amount within a period of four weeks from today. 8. Accordingly, the instant writ petition stands disposed of in the manner indicated above.
