Respondents Represented by Adv.- CORAM: JUSTICE KRISHNA SHRIPAD DIXIT JUSTICE CHITTARANJAN DASH ORDER 13.03.2026 This Intra-Court Appeal seeks to lay a challenge to a learned Single Judge’s order dated 11.11.2022, whereby Respondent- employee’s WP(C) No.38088 of 2021 having been favoured, following relief has been accorded: “In view of the above settled position of law, nothing remains to be reconsidered by this Court. Accordingly the Opposite Parties are directed to extend all such benefits in favour of the Petitioner in terms of the directions given by the Courts as mentioned above, as expeditiously as possible, preferably within a period of eight weeks from the date of communication of the certified copy/authenticated copy of the order” Having heard learned AGA appearing for the Appellant and having perused the appeal papers, we are convinced that the subject matter of this appeal is substantially similar to the one in W.A. No.17 of 2023 between State of Odisha v. Krushna Chandra Order No. 01. Mallick, disposed off by us vide order dated 15.07.2025 and therefore, this Appeal too has met the same fate of dismissal. Ordered accordingly and Writ Appeal is rejected in limine. Order of the learned Single Judge to be implemented within a period of three months. Even otherwise, we do not undertake deeper examination of the matter, inasmuch as Appeal has been filed after brooking a long delay of 583 days and the explanation offered for the same in terms of application in I.A. No.5199 of 2024 supported by the affidavit does not constitute a plausible explanation, delay being too long. The sages of law have already said that a litigant, who sits over his rights cannot one fine day get up from the deep slumber to knock at the doors of the Writ Court successfully. Registry to send a copy of this order to the Respondent- employee immediately by speed post. Web copy of order to be acted upon by all concerned.
