By the way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’), the petitioner is seeking quashing of FIR No. 104/2023, registered at Police Station Jagatpuri, Delhi, for the offences punishable under Sections 354/506 of Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties. 3. Issue notice. The learned APP accepts notice on behalf of the State. 4. The petitioners and respondents no. 2 are present before this Court and have been identified by their counsel and Investigating Officer. This is a digitally signed order. 5. Briefly stated, the petitioner Vikram and respondent No.2 are cousins and were involved in a long-standing family dispute concerning ancestral property. On 08.02.2023, following a dispute over possession of the first floor of the house, respondent No.2 alleged that the petitioner misbehaved with and pushed her, pursuant to which FIR No. 104/2023 under Sections 354/506 IPC was registered at P.S. Jagatpuri. The police thereafter filed the charge- sheet and the case was pending before the Trial Court. During the pendency of the proceedings, the parties amicably settled their disputes through mediation and executed a settlement agreement dated 10.12.2024. 6. On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has entered into compromise, vide Settlement Agreement dated 10.12.2024, out of her own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed. 7. The parties also submit that a cross-FIR between the parties also stands quashed. 8.
In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9. Accordingly, FIR No. 104/2023, registered at Police Station – Jagatpuri, Delhi, for the offences punishable under Sections 354/506 of the IPC along with all consequential proceedings emanating therefrom, is hereby quashed.
