The present application has been filed by the Applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) read with Section 439 of the Code of Criminal Procedure, 1973 (hereinafter referred to as the ‘CrPC’), in FIR No. 75/2018 registered at Police Station Narela for the offences punishable under Sections 302/365/201/34 of the Indian Penal Code (hereinafter referred to as the ‘IPC’), seeking grant of regular bail. 3. Learned counsel for the Applicant submits that the Applicant is facing trial for the last eight years and has been in custody for more than five years and seven months. He further submits that it was only during the COVID-19 period that he was granted bail on the directions of the HPC. Further, at the time of the death of his father, he was granted interim bail for four months, and he never misused the liberty granted to him. 4. During the period of nine years, 24 witnesses out of 35 have been examined and 11 witnesses still remain to be examined. Therefore, the completion of the trial will take further time. 6. Learned counsel for the State submits that it is a heinous crime, and out of the last eight years, the applicant remained outside jail for about three years. It is further submitted that the trial is at the fag end and releasing the Applicant on bail at this stage would hamper the trial. 7. In the facts and circumstances of the case, considering that the Applicant has remained in judicial custody for more than five years, let the Applicant be released on bail, on furnishing a personal bond of Rs.25,000/- with one surety of the like amount, to the satisfaction of the learned Trial Court, subject to the following conditions: i. The Applicant shall not leave India without prior permission of the learned Trial Court. ii. The Applicant shall intimate the learned Trial Court by way of an Affidavit and to the Investigating Officer (IO) regarding any change in residential address. iii. The Applicant shall report to the office of the concerned SHO, Police Station Narela, on the first Monday of every month at 11:00 a.m., and shall be discharged by 12:00 noon after recording his presence and completion of all necessary formalities. iv. The Applicant shall be available to the Investigating Officer as and when required, and shall furnish his mobile number to the Investigating Officer and keep the same operational at all times. v.
