For Petitioner: Mr.S.Gopalakrishnan For Respondents: Mr.R.Chakkaravarthy Government Counsel for R1 No appearance for R2 https://www.mhc.tn.gov.in/judis WP No. 1976 of 2024 __________Page 2 of 4 ORDER The petitioner Insurance Company challenges the orders dated 20.01.2023 in E.C.No.4 of 2016 passed by the first respondent, directing payment of Rs.5,10,501/-. 2. The impugned order was passed on 20.01.2023 directing the petitioner Insurance Company to pay Rs.5,10,501/- as compensation to the 2nd respondent herein. The Insurance Company on 28.07.2023 issued a Demand Draft in favour of the first respondent viz., Labour Commissioner, Coimbatore for the entire award amount of Rs.5,10,501/-. However, according to the petitioner, interest component ought not to have been levied on the Insurance Company. 3. The only ground raised by the learned counsel for the petitioner is that the interest cannot be vested on the Insurance Company for the award amount. 4. The first respondent in his order dated 20.01.2023, had relied on the Judgment of the Allahabad High Court in United India Insurance Company Limited Vs. Ram Kishore and ors. reported in 2019 (161) FLR 434 for levy of interest component and based on the said Judgment, the interest was levied on the petitioner. https://www.mhc.tn.gov.in/judis WP No. 1976 of 2024 __________Page 3 of 4 5. Since the issue has already been settled by the Hon'ble Allahabad High Court, I have no reason to interfere with the impugned order. 6. Accordingly, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. (K. SURENDER,J.) 15-07-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No vum To 1.
