The Contempt petition has been filed alleging wilful disobedience of the order dated 10.05.2023, passed in WP(C) No. 2490/2023. It is submitted that the Respondents No. 2 and 3, during pendency of the contempt petition, had demitted their offices and new incumbent have been appointed. Accordingly, this present application has been filed seeking impleadment of the present incumbent, namely the District Elementary Education Officer, Kamrup, Amingaon and the Deputy Commissioner (now District Commissioner), Kamrup, Amingaon cum The Chairman, District Level Committee, Amingaon, Kamrup as a party respondents No. 4 and 5 in the contempt case. The learned counsel appearing for the Respondent No. 1 does not object to the prayer made. Considering the submissions made and the averments in the Interlocutory Application, this Court is of the view that this Interlocutory Application can be allowed without issuing notice and calling for objections as the newly impleaded respondents will have their opportunity to file their objections or affidavits in the present contempt petition. Mishra, the Deputy Commissioner (now District Commissioner), Kamrup, Amingaon cum the Chairman, District Level Committee, Amingaon, Kamrup are arrayed as party Respondents No. 4 and 5 in the Contempt Case No. 90/2024.
