BHARDWAJ The present petition has been filed under Section of Criminal Procedure, 1973 (now Section Suraksha Sanhita, 2023 bearing No.152 dated 13.04.2019 registered un 427 of the Indian Penal Code, 1860 Mewat alongwith all consequential proceedings arising therefrom direction was sought to conduct fair and proper investigation in FIR No.134 dated 31.03.2019 registered under Sections 148, 149, 323, 506 (Section 452 wrongly deleted) of the Ferozepur Jhirka, District Mewat 2. The matter came up for hearing on 13.05.2019, when t for seeking quashing of the cross version was given up. The prayer was confined only to fair investigation in case bearing FIR No.134 dated 31.03.2019. The present petition has been filed under Section 482 of the Code 528 of the Bharatiya Nagarik seeking quashing of the impugned cross version FIR der Sections 148, 149, 323, 506, at Police Station Ferozepur Jhirka, District Mewat alongwith all consequential proceedings arising therefrom and a further direction was sought to conduct fair and proper investigation in case bearing FIR No.134 dated 31.03.2019 registered under Sections 148, 149, 323, 506 Indian Penal Code, 1860 at Police Station The matter came up for hearing on 13.05.2019, when the prayer FIR bearing No.152 dated 13.04.2019 was given up. The prayer was confined only to fair investigation in case bearing FIR No.134 dated 31.03.2019. Counsel for the petitioner, at the very outset, submits that he may be permitted to withdraw the petition qua the prayer for seeking quashing of the impugned cross-version i.e. FIR No.152 dated 13.04.2019 (Annexure P2) registered under Sections 148, 149, 323, 506, 427 IPC at Police Station Ferozepur Jhirka, District Mewat, at this stage. Ordered accordingly. Counsel for the petitioner has submitted that the police is not properly investigating the FIR No.134 dated 31.03.2019 (Annexure P1) registered under Sections 148, 149, 323, 506 IPC (Section 452 IPC wrongly deleted during investigation) at Police Station Ferozepur Jhirka, District Mewat. Notice of motion for 09.09.2019.” 3. Learned State Counsel on instructions from ASI Sarita, No.118/Nuh, P.S. Zhirka (Mewat), Nuh contends that as per the reply filed by the respondents-State by way of an affidavit of Anil Kumar, HPS, Deputy Superintendent of Police, Ferozepur, the investigation in the case is already complete and that a final report stands filed and Section 452 IPC has since then been deleted and Section 325 IPC had been added. 4. In view of the above, no further cause of action subsists in the present petition and accordingly the same is disposed of as having been rendered infructuous. 5.
