1. By way of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks regular bail in connection with FIR No. 705/2014 dated 18.11.2014, registered at Police Station Ashok Vihar, District North-West, Delhi, under Section 363 of the Indian Penal Code, 1860.
2. After detailed arguments, Mr. Sauraj Yadav, learned counsel for the applicant, seeks permission to withdraw the bail application unconditionally.
3. Accordingly, the bail application, alongwith pending application, is dismissed as withdrawn.
4. Mr. Yadav points out that, by order dated 08.04.2026, the learned Sessions Court has allowed an appeal filed by the applicant against an
order of the Juvenile Justice Board [“JJB”] dated 14.02.2022, whereby his age was declared to be more than 18 years, on the date of the alleged This is a digitally signed order. It is made clear that the rights and contentions of the parties before the JJB remain reserved, and the JJB is directed to act as expeditiously as possible.
5. At this stage, Ms. Manjeet Arya, learned Additional Public Prosecutor for the State, submits that the rights and remedies of the prosecution, including the remedy of challenge to the order of the learned Sessions Court dated 08.04.2026, be reserved.
6. It is made clear that this Court has made no observation on the merits of the case, and the present order does not prejudice any rights and
contentions of the parties, which may be considered by the appropriate forum in accordance with law.
