It is brought to the notice of this Court by the learned counsel for the petitioners that by order dated 01.04.2026 passed in this revision, the interim stay of further proceedings in O.S.No.2366 of 2021, pending before the XXIV Assistant City Civil Court, Chennai was granted. It is also brought to the notice of this Court that on the very same day (i.e., on 01.04.2026), an exparte decree came to be passed in favour of the respondent/plaintiff by the XXIV Assistant City Civil Court, Chennai in O.S.No.2366 of 2021. He further submitted that an application was filed by the petitioners/defendants before the XXIV Assistant City Civil Court, Chennai seeking to set aside the exparte decree passed in O.S.No.2366 of 2021. After filing the application before the trial court seeking to set aside the exparte decree, the petitioners have also filed another revision before this Court in C.R.P.No.3215 of 2026 seeking stay of the decree passed by the XXIV Assistant City Civil Court, Chennai on 01.04.2026 in O.S.No.2366 of 2021. By order, dated 11.06.2026 passed in C.R.P.No.3215 of 2026, this Court, after giving due consideration to the fact that in this revision, the petitioners were having the benefit of interim stay of further proceedings in O.S.No.2366 of 2021 on the file of the XXIV Assistant City Civil Court, Chennai, has granted stay of execution of the decree dated 01.04.2026 passed by the XXIV Assistant City Civil Court, Chennai. https://www.mhc.tn.gov.in/judis CRP No. 1972 of 2026 ____________ Page No.3 of 5 3. In view of the subsequent revision filed by the petitioners in C.R.P.No.3215 of 2026 and in view of the fact that the petitioners are having the benefit of interim stay of execution of the decree dated 01.04.2026 passed in O.S.No.2366 of 2021 by the XXIV Assistant City Civil Court, Chennai, the prayer sought in this revision has now become infructuous as it got merged with the prayer sought in C.R.P.No.3215 of 2026, which is the subsequent revision filed by the petitioners. 4. Accordingly, this Civil Revision Petition is disposed of as infructuous by granting liberty to the petitioners to raise all contentions in C.R.P.No.215 of 2026, which includes the grounds raised by the petitioners in this revision.
