This petition has been filed seeking issuance of directions to the Motor Accident Claims Tribunal, East, Karkardooma Courts, Delhi [‘MACT/Tribunal’], to dispose of MACT Case No.382/2019, within a fixed time frame. 2. This petition has been filed in context of the fact that the accident in question occurred on 04th December 2017, i.e. around 9 years ago; the claim petition was subsequently filed in 2019, however, the same has still not been decided. 3. Ms. Pooja Goel, counsel for petitioner/claimant, submits that claimant was 18 years of age at the time of the accident, and has suffered serious injuries and disabilities as a result of the accident. She has also been hospitalized a number of times but compensation has still not been awarded. 4. The matter was fixed for final arguments on 19th July 2023. On 07th December 2024, the new Presiding Officer, sought to summon the Investigating Officer [‘IO’] once again for clarification on the CCTV This is a digitally signed order. The IO was thereby summoned for 28th January 2025, but he failed to appear on the said day. Consequently, vide last order dated 24th March 2026, passed by the MACT, the IO has been summoned yet again by the Presiding Officer. 5. In these circumstances, there is no doubt that plea of the petitioner/claimant is genuine and legitimate. There is no reason why the MACT cannot take steps to conclude the matter, considering that it has been pending for final arguments since the past 3 years. 6. Accordingly, if the MACT wishes to receive further assistance/information from the IO, it shall take immediate steps to summon the IO and ascertain the same in accordance with the powers available to it. 7. It is informed that the matter is listed before the MACT on 30th October 2026. 8. In light of the aforesaid, let the matter be listed before the MACT on 17th September 2026, for further directions as well as to facilitate the conclusion of this matter. 9. The matter shall be concluded by the MACT on or before 15th December 2026. 10. It is made clear that this Court has not made any observations on the merits of the matter. 11. This petition stands disposed of in above terms. 12. Pending applications, if any, are rendered infructuous. 13. Order be uploaded on the website of this Court.
