Baruah, learned Additional Public Prosecutor for the State. 2. By this application, the petitioner has prayed for pre-arrest bail in connection with Bongaigaon Police Station Case No. 292/2025 registered under Section 305(a)/317(2) of BNS, 2023. The FIR in connection with which the Page No.# 2/3 petitioner is apprehending arrest was lodged on 16.11.2025 by the employee of M/S G.B. Construction stating inter alia that he was deputed as site in-charge of M/S G.B. Construction for the project of construction of Salakati-APM, (Jogighopa) 132 KV Single Circuit Transmission Line and that on 16.11.2025 in the morning hours, the driver i.e. the petitioner who was engaged apprised him that the Bolero vehicle has been missing from the store yard and that the said vehicle was parked in front of the Police Station. The informant thereafter rushed to the Police Station and he was informed that the said vehicle was found in an abandoned condition and some materials were recovered from the said vehicle. The informant alleged that he had suspicion that the driver i.e. the petitioner along with other associates are involved in the incident of stealing the vehicle as well as the materials. 3. The learned Counsel for the petitioner submits that the petitioner being the driver of the said vehicle informed the informant about missing of the same and that he is not involved in taking the vehicle or in stealing the materials used in the construction work. 4. Mr. R.J. Baruah, learned Additional Public Prosecutor for the State submits that during the pendency of the instant application, the charge sheet was submitted and the petitioner could have approached the Trial Court for bail as has been done by the other accused person. 5. Upon considerations of the submissions made by the learned Counsels for the parties and more so in view of the fact that the FIR was lodged on suspicion against the petitioner, this Court deems it fit to enlarge the petitioner on pre- arrest bail on furnishing of bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of Arresting Authority under the following conditions: Page No.# 3/3 i) the petitioner will appear before the Investigating Officer within a period of 10 days from the date of the order. ii) the petitioner will appear before the Investigating Officer thereafter as and when call for. iii) the petitioner will not hamper, tamper with the evidence, neither influence the witnesses connected with the case. iv) the petitioner will not leave the place of jurisdiction without the permission of the Arresting Authority. 6.
