Through the present petition, the petitioner seeks to challenge the order dated 01.09.2026 passed by the learned executing court whereby the learned presiding officer recused from the case and directed the parties to appear before the learned Principal District & Sessions Judge with a request to transfer the underlying case to any other court. 2. It has been submitted by the learned counsel for the petitioner that the JD has been moving numerous frivolous applications before the executing court making allegations against previous and now present presiding officer forcing the learned presiding officers to recuse and transfer the case to another court. This patently perverse dilatory tactic has stalled the execution proceedings. This is a digitally signed order. While this Court deems it appropriate not to pass any order, however, is of the firm opinion that such practices are depreciable and against the nature of proceedings in good faith. 4. With this observation, this Court deems it appropriate to dispose of the petition with the directions to the executing Courts to not be influenced by any such attempts and to hear the matter on merits of the case.
