IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.1952 of 2026 Haramani Dei @ Hara Rout & others …. Petitioners M/s. B.P. Mohanty, Advocate & Associates -Versus- State of Odisha …. Opposite Party Mr. B.P. Nayak, AGA CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 08.04.2026 01. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Brahmagiri P.S. Case No.34 of 2026 corresponding to G.R. Case No.39 of 2026 pending in the file of learned Nyayadhikari Gramya Nyayalaya, Brahmagiri on the grounds stated. 3. The circumstances under which the alleged incident took place have been narrated in the FIR. All the offences are bailable in nature except the one under Section 74 BNSS. It is submitted to the Court by learned counsel for the petitioners that lodging of the report is an outcome of political rivalry and personal dispute between the parties. One of the injured, who is also the informant received a laceration but as per the medical examination report produced at the time of hearing by learned counsel for the State, the same is simple in nature. A copy of the chargesheet is also produced along with the case diary for the Court’s perusal. Since the investigation is over and the petitioners have not been arrested till date, this Court, though not in favour of granting pre-arrest bail to any of them but is of the view that the petitioners, two of whom are lady members and one of them is an elderly person, should be directed to surrender before the learned court below for being released with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned Nyayadhikari Gramya Nyayalaya, Brahmagiri in connection with Brahmagiri P.S. Case No.34 of 2026 corresponding to G.R. Case No.39 of 2026 within a fortnight from today, they shall be released on bail upon furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) each with one solvent surety for the like amount each with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge TUDU Designation: Sr. Stenographer
