The present writ petition has been filed seeking directions to respondent no.1/ MCD and respondent no.2/ SHO, P.S. Kalindi Kunj, to immediately take action and to stop and demolish the illegal and unauthorized construction work, being carried out by respondents no.3, 4 and 5 in the property bearing No. H-40, land measuring 693.25 sq. yds. Khasra No. 881-882, Block-H, Jaitpur Extn Part-2, Badarpur, Delhi-110044 (hereinafter ‘subject property’). 2. Notice was issued in the present petition on 14th November, 2025 and the respondents were directed to ensure that no further unauthorized construction takes place in the subject property. 3. A status report dated 15th May, 2026, has been handed over in Court by counsel for the respondent no.2/ SHO, P.S. Kalindi Kunj. 3.1. The same is taken on record 4. In the said status report, it is stated that the address of the petitioner given in the writ petition was visited by the Police and it came to light that the fourth floor of the subject property has been given on rent to the petitioner who is otherwise a resident of Meerut. The said status report also discloses that the petitioner is only staying in the subject property for about ten (10) days in a month. It is also disclosed that the petitioner has stopped coming to the subject property after one month though the rent is being remitted by him. Subsequently, the petitioner was never found at the subject property for further verification of any previous address. 5. A status report dated 20th February, 2026 has also been filed on behalf of the respondent no.1/ MCD wherein it is stated that after following due process of law, demolition action has already been taken on 6th January, This is a digitally signed order. The status report filed on behalf of respondent no.2/ SHO, P.S. Kalindi Kunj raises a serious doubt with regard to the locus of the petitioner to file the present writ petition. 7. Accordingly, this Court is not inclined to entertain the present writ petition. However, MCD is directed to take requisite action, in accordance with law, against the subject property. 8. All rights, contentions and legal remedies of the private respondents no. 3 to 5/ owners/ occupiers are kept open. 9. Pending applications stand disposed of. CONT.CAS(C) 1950/2025 10. A status report dated 20th February, 2026, has been handed over in Court by counsel for the respondent no.1/ MCD. The same is taken on record. 11.
