In this petition, filed under Article 226 of the Constitution of India, the petitioner has thrown challenge to an order dated 04.08.2026, passed by the Central Administrative Tribunal, Srinagar [“the Tribunal”] in OA No. 826/2026 titled “Mohd Adil Taili Vs. Sports and Youth Services Department”, whereby the learned Tribunal has deferred the consideration of interim relief till the filing of objections by the other side. The impugned order, though interim in nature, has been called in question on the ground that, having regard to the nature of relief prayed for, if the interim relief is not granted at the earliest, the OA will become infructuous. Having heard learned counsel for the parties and regard being had to the nature of controversy involved, we are of the considered opinion that an interim arrangement, as under, would meet the ends of justice: 1. That one post in the Non-Gazetted cadre earmarked for appointment of Outstanding Sports Person, to which the petitioner may be entitled to in view of his position in the general merit list, shall be kept reserved, provided the said post has not been already filled up. This order would subsist till the objections are filed by the respondents and the matter with regard to interim relief is heard on merits. Disposed of.
