By way of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks regular bail in connection with FIR No. 171/2024 dated 12.07.2024, registered at Police Station Gulabi Bagh, District North, Delhi, under Sections 331(6)/310(2)/311/3(5) of the Bharatiya Nyaya Sanhita, 2023 [“BNS”], and Sections 25/27 of the Arms Act, 1959 [“the Arms Act”].
2. I have heard Ms. Kirti Chauhan, learned counsel for the applicant, and Mr. Hitesh Vali, learned Additional Public Prosecutor. The complainant has also been served, and was appearing on the last two dates of hearing through
learned counsel, but is not represented today. 3. Mr. Vali has handed over a Status Report dated 08.07.2026, which is taken on record. 4. The FIR was registered at the instance of Mr. Dev Karan Anchaliya, stated to be an agent of the cash collection office of M/s Bikaner Assam Road Lines India Limited, which has its office at House No. 18/473, Flat No. 301, Third Floor, Mahaveer Bhawan, Nai Basti, Kishanganj, New Delhi. b. The complainant alleged that 8 persons entered the office at around 10:30 PM on 11.07.2024, and fled with cash of Rs. 30,00,000/-. The complainant later alleged that the total amount looted was to the tune of Rs. 4,08,00,000/-. c. The examination of proximate CCTV footage revealed that a group of 10 to 12 suspects were seen approaching the location from Pratap Nagar Metro Station, conducting reconnaissance of the area, and exiting the premises with bags filled with the looted cash. Their arrival and departure are stated to have taken place in two vehicles – [i] a silver Hyundai i10 bearing registration No. DL-7CK-5228, and [ii] a grey Honda Civic bearing registration No. DL-3CBM-8424. d. The status report enumerates recovery from twelve accused persons, who have been arrested. The present applicant was arrested on 18.07.2024, alongwith co- accused Amit Kumar @ Badal, Sachin Gupta, Ranjan Kumar @ Ranjan Pandit, and Naresh Kumar. f. Upon completion of the investigation, a chargesheet was filed under Sections 331(6)/310(2)/311/317/3(5)/61(2) of the BNS, and Sections 25/27 of the Arms Act. 5. The principal argument of Ms. Chauhan, in support of the present application, concerns parity with other co-accused persons. She submits that the role attributed to the applicant in the status report filed by the State, is as follows:
“v. Mohd. Tanzeem – He was the one of the main conspirator of the dacoity. He had engaged his close associates namely (i) Dev Kumar @ Deepanshu (ii) Shanu Ali (iii) Faisal. He also participated in reconnaissance and deployed lookouts around the SOC during the robbery.”

Learned counsel submits that the applicant was not one of those, who was actively involved in the incident. However, he is accused of having participated in the reconnaissance, and engaging other associates. Further, recovery to the tune of Rs. 21,48,000/- has also been attributed to him. She points out that, in the status report, the role attributed to Pramod Singh Tomar [wrongly named therein as Pramod Singh Chauhan], is as follows:

BAIL APPLN. 1944/2026 jail. He participated in the planning and reconnaissance of the SOC and helped mobilize other accused persons for the robbery.”
7. Pramod Singh Tomar has been released on bail vide order dated 26.02.2026 in BAIL APPLN. 3806/2025. 8. Mr. Vali, on the other hand, submits that the applicant is accused of a serious offence, and a substantial recovery has been effected from him. However, he does not contest the position that the role attributed to the present applicant is similar to that attributed to other co-accused who have been enlarged on bail. 9. Having heard learned counsel for the parties, I am of the view that the applicant is entitled to bail in the present case on the ground of parity. The role attributed to co-accused Pramod Singh Tomar also involves mobilisation of other accused and participation in reconnaissance. He has been granted bail, by the aforesaid order of this Court. 10. Proceeding on the aforesaid basis, it is directed that the applicant be released on regular bail in connection with FIR No. 171/2024 dated 12.07.2024, registered at Police Station Gulabi Bagh, District North, Delhi, under Sections 331(6)/310(2)/311/3(5) of the BNS, and Sections 25/27 of the Arms Act, and subject to furnishing of a bail bond in the sum of Rs. 35,000/-, with one surety in the like amount, to the satisfaction of the concerned Trial Court/Duty Magistrate, and subject to the following further conditions: a. The applicant shall appear before the Sessions Court on each and every date fixed.
b. The applicant shall ordinarily reside at the address as per prison records, and shall not change the address without informing the concerned Investigating Officer [“IO”]/Station House Officer This is a digitally signed order. BAIL APPLN. 1944/2026 [“SHO”]. c. The applicant shall provide his mobile number to the concerned IO/SHO, which shall be kept in working condition at all times. The mobile number shall not be switched off or changed without prior intimation to the IO/SHO during the pendency of the trial. d. If the applicant has a passport, he shall surrender the same to the Sessions Court, and shall not leave the country without the prior permission of the Sessions Court. e. The applicant shall not, directly or indirectly, contact, visit, nor offer any inducement, threat, or promise to any of the prosecution witnesses or other persons acquainted with the facts of the case. f. The applicant shall not tamper with evidence nor otherwise indulge in any act or omission that would prejudice the proceedings in the pending trial. g. The applicant shall not commit any offence during the period of their release. 11. The bail application is disposed of in terms of the above. 12. It is clarified that any observations made in the present order are solely for the purpose of deciding the present bail application, and shall neither influence the trial proceedings, nor be construed as an expression of opinion on the merits of the case. 13.
