ORDER This Writ Petition (Criminal) has been filed seeking a direction to the respondents 1 and 2 to transfer the investigation in respect of the petitioner’s complaint dated 17.04.2026 from the file of the third respondent to the file of the CBCID.
2. Heard the learned counsel appearing for the petitioner and the
learned Counsel for Government of Tamil Nadu (Criminal Side) appearing for the respondents 1 to 3. Perused the materials available on record.
3. It is seen that the question of the transfer of enquiry does not arise at this stage, since the complaint lodged by the petitioner has been received and the petitioner was issued CSR No.149 of 2026. Pending enquiry at the CSR stage, the question of transferring the investigation does not arise. The transfer of investigation would arise only after registration of the FIR. Therefore, the investigation cannot be transferred from the file of the third respondent to the file of the CBCID.
4. In view of the above, the third respondent is directed to conduct an enquiry on the complaint lodged by the petitioner, after issuing notice to the petitioner and the fourth respondent, and dispose of the same on merits and in https://www.mhc.tn.gov.in/judis
WP Crl. No. 1943 of 2026 __________ Page3 of 4 accordance with law, within a period of two weeks from the date of receipt of a copy of this order. During the course of investigation, if any cognizable offence is made out against the fourth respondent, the third respondent is at liberty to register an FIR and proceed further in accordance with law.
