C.R.P. Nos. 1943 of 2026 O R D E R This civil revision petition has been filed challenging the impugned order dated 03.01.2026 passed by the Special Court under the Protection of Women from Domestic Violence Act, Coimbatore in M.P. NO. 1 of 2025 in DVC No. 65 of 2024. 2. By the aforesaid order, the names of the respondents, who are the in-laws of the petitioner have been deleted from the array of parties in DVC No. 65 of 2024 for the following reasons: (a) The married couple did not have a shared household with the respondent. (b) Vague allegations have been made against the respondents for arraying them as party respondents in DVC proceedings. 3. Even though the learned counsel for the petitioner, during the course of his submissions, submitted that, initially, the married couple as well as the respondents were staying together, in the very same house, there is no evidence placed on record before the Court below to prove that the married couple as well as the respondents were staying together in 2\4 https://www.mhc.tn.gov.in/judis
C.R.P. Nos. 1943 of 2026 the same house. When there is no evidence placed on record, the question of accepting the contention of the learned counsel for the petitioner by this Court does not arise. Only based on vague allegations made against the respondents, who are the in-laws of the petitioner, the respondents were made as party respondents in the proceedings in DVC No. 65 of 2024.
The Court below, while allowing the application in M.P. No. 1 of 2025 filed by the respondents, has considered the materials available on record as well as the averments made by the petitioner for filing DVC No. 65 of 2024 and only thereafter, has come to the correct conclusion that the respondents cannot be arrayed as party respondents in DVC No. 65 of 2024 and that they have been rightly deleted from the array of party respondents in DVC No. 65 of 2024. 4. For the foregoing reasons, this Court does not find any merit in this civil revision petition and it is accordingly dismissed. No costs.
