Sahu, AGA CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 08.04.2026 01. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Jamboo Marine P.S. Case No.12 of 2026 corresponding to G.R. Case No.243 of 2026 pending in the file of learned S.D.J.M., Kendrapara on the grounds stated. 3. Perused the FIR as at Annexure-1. The allegation as per the FIR is regarding dowry demand by the family of petitioner No.1. The Court finds that the allegation of such demand is omnibus and directed against all. In fact, petitioner No.1 is the husband of the informant, whereas, petitioner Nos.2; 3 and 4 are her brother-in-law and parents-in-law respectively. Mr. Parida, learned counsel for the petitioners submits no injury has been received by the informant as a result of the excess allegedly committed by the petitioners. Recorded the objection of the State. Considering the allegations in the FIR that the informant was assaulted and such assault is attributed to petitioner No.1, this Court under the above circumstances, is inclined to direct them to mediation but at the same time, is in favour of allowing petitioner Nos.2 to 4 to surrender before the learned court below and to go on bail with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned S.D.J.M., Kendrapara in connection with Jamboo Marine P.S. Case No.12 of 2026 corresponding to G.R. Case No.243 of 2026 within a fortnight from today, they shall be released on bail upon furnishing a bail bond of Rs.25,000/-(rupees twenty-five thousand) each with one solvent surety for the like amount each with other conditions imposed besides the following, such as, they shall not cause any harm to the informant in any manner, whatsoever, while on bail and to co-operate the IO in the investigation. It is further directed that petitioner No.1 shall attend the High Court Mediation Center, Cuttack on 23rd April, 2026 for the purpose of mediation. State is directed to intimate the informant about the mediation and her appearance on the date fixed with the assistance of the local PS. 6. Issue urgent certified copy of this order as per rules.
