By the way of the present petition the petitioner is seeking quashing of FIR No. 0162/2024, registered at Police Station Janakpuri, District west, Delhi, for the offences punishable under Sections 279 and 338 of Indian Penal Code,1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties. 3. Issue notice. The learned APP for the state accepts notice on behalf of the State. 4. The petitioner and respondent no. 2 are present before this Court and have been identified by their counsel and Investigating Officer. This is a digitally signed order. Briefly stated, on the night of 19.04.2024, respondent No.2/complainant was proceeding from Sagarpur Red Light towards Uttam Nagar Chowk on scooty bearing No. DL-9SBM-7047 when a white XUV- 700 allegedly hit the scooty from behind, resulting in injuries to him. FIR No. 0162/2024 was accordingly registered at P.S. Janakpuri initially under Sections 279/337 IPC. During investigation, the petitioner joined pursuant to notice under Section 41A Cr.P.C.; the vehicle was seized and mechanically inspected. Upon the injuries being opined as grievous in MLC No. 13104/24, Section 338 IPC was added and charge-sheet under Sections 279/338 IPC was filed before the learned Trial Court. 6. During pendency of the proceedings, the parties entered into a settlement dated 21.12.2024 before the Delhi Mediation Centre, Dwarka Courts, for a sum of ₹55,000/-, which stands paid by the petitioner. Consequently, the offence under Section 338 IPC was compounded by the learned Trial Court on 24.12.2024, whereas proceedings under Section 279 IPC remained pending. Hence, the present petition seeking quashing of the FIR. 7. On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that he has entered into compromise, vide Settlement Agreement dated 21.12.2024, out of his own free will and without any pressure, coercion or threat. Therefore, he has no objection if the present FIR is quashed. 8. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. There is no legal impediment in quashing the FIR in question. 9. Accordingly, FIR No. 0162/2024, registered at Police Station Janakpuri, District West, Delhi, for the offences punishable under Sections 279 and 338 of the IPC, 1860, along with all consequential proceedings emanating therefrom, is hereby quashed. 10. The present petition is disposed of. Pending application(s), if any, also stand(s) disposed of. 11. A copy of this order be communicated to the concerned learned Trial Court for necessary information and compliance. 12. The order be uploaded on the website forthwith.
