1. Heard learned counsel for the petitioner and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Titlagarh P.S. Case No.01 of 2025 corresponding to G.R. Case No.06 of 2025 pending in the file of learned S.D.J.M., Titlagarh on the grounds stated.
3. Perused the FIR as at Annexure-1. It is submitted to the Court that the petitioner does not have any antecedent but he apprehends arrest and implication in the case on the strength of disclosure made by the co-accused, namely, Nitgin Dalei. The FIR reveals that there was robbery by unknown miscreants from the shop of the informant. In fact, unknown culprits committed the theft and in that connection, one of the accused above named was arrested and he apparently disclosed the name of the petitioner, hence, the apprehension of arrest. But in view of the preliminary chargesheet filed in the month of
March, 2025 and in the meantime, more than a year has gone by, recording the submission that the petitioner is having no similar antecedent, this Court directs him to surrender before the learned court below for being released instead of entertaining his plea for pre-arrest bail as no case is made for the same.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned S.D.J.M., Titlagarh in connection with Titlagarh P.S. Case No.01 of 2025 corresponding to G.R. Case No.06 of 2025 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.40,000/-(rupees forty thousand) with one solvent surety for the like amount with such other conditions imposed besides the following, such as, he shall co-operate the IO in the further investigation pending at present without fail. The above
order, as is directed, shall not be given effect to, if the petitioner is having similar antecedent.
6. Issue urgent certified copy of this order as per rules.
