1. The present Writ Petition has been filed under Article 226 of the Constitution of India, read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce Ms.S, who is stated to be the wife of the petitioner. It is stated that she has been forcibly kept away from the petitioner by her relatives, that are, respondent nos.5 to 9. 2. A Status Report dated 08.07.2026 was filed before us, inter alia, stating that Ms.S has given a statement to the Police that she had left her parental home on 26.03.2026 out of her own free will, without This is a digitally signed order. informing any family member, and had stayed with one of her friends, and has now voluntarily returned to her parental residence. 3. On 08.07.2026, in spite of the said Status Report, we indicated that we would like to interact with Ms.S once to satisfy ourselves that she was not forcibly confined by respondent nos. 5 to 9. 4. Accordingly, she was directed to be produced before us in person today. 5. The order has been complied with, and Ms.S has appeared before us today. 6. We have interacted with Ms.S. She has indicated that she married the petitioner herein and would like to reside with him. She further stated that it was because of emotional blackmail and threats that she had earlier stated that she did not wish to go with the petitioner. 7. Given the fact that she is around 26 years old and wishes to stay with the petitioner, she cannot be stopped from doing so. 8.
The petitioner and Ms.S further state that their documents, such as their passports, Aadhaar cards, etc., are in the custody of respondent nos.5 to 9 at the residence of Ms.S.
9. We, accordingly, direct the SHO of Police Station Trilokpuri to depute a Constable who shall visit the house of Ms.S and collect their documents. Respondent no.6 namely Abid, who is also present in person before us, has been advised that all the documents of Ms.S should be handed over, and if any documents of the petitioner are also in the possession of respondent nos.5 to 9, those documents should also be handed over to the Constable who will be visiting their house This is a digitally signed order. We further direct the SHO of Police Station Trilokpuri or of any other concerned Police Station within whose jurisdiction the petitioner and Ms.S decide to reside in Delhi, to share his/her mobile number as also the mobile number of the Beat Constable of the concerned area. In the event of any apprehension of threat, the concerned police authorities shall provide adequate security to the petitioner and Ms.S.
