JUSTICE SASHIKANTA MISHRA ORDER 21.04.2026 1. This matter is taken up through hybrid mode. 2. Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State. 3. The Petitioner is in custody since 15th December, 2025 in connection with Soro P.S. Case No.1051 of 2025 corresponding to C.T. Case No.1992 of 2025 pending in the Court of learned J.M.F.C., Soro for the alleged commission of the offence under Sections 310(4)/310(5) of the BNS, 2023 and 4 & 5 of Explosive Substance Act and 25 & 27 of the Arms Act. 4. It is alleged that the petitioner and four other persons committed dacoity on the National Highway from the drivers of the vehicles plying on such road. It is submitted that the three of the co-accused persons have been granted bail by a co-ordinate Bench of this Court in BLAPL Nos.171 of 2026, 269 of 2026 and 471 of 2026. It is further submitted that the petitioner stands on the same footing. 5. Learned counsel for the State also fairly submits that the petitioner stands on the same footing with the co-accused persons, Order No. 01 . who have been admitted to bail. 6. Considering the submissions, the materials on record and the fact that the co-accused persons have been released on bail, this court finds no reason to treat the petitioner differently. The bail application is allowed. Let the petitioner be released on bail on such terms and conditions as the Court below may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without seeking representation. 7.
