1. Heard learned counsels for the respective parties.
2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Dhenkanal Town P.S. Case No.54 of 2026 corresponding to G.R. Case No.134 of 2026 pending in the file of learned S.D.J.M., Dhenkanal on the grounds stated.
3. Perused the FIR as at Annexure-1. Recorded the
submissions of learned counsel for the respective parties. The details of the mischief committed by the accused persons stand narrated in the FIR. It is submitted to the Court by learned counsel for the petitioners that one of the accused persons, namely, Susanta Kumar Dalei, who was arrested in connection with the case, is on bail at present. Learned counsel for the
informant objects to the plea of bail of the petitioners with the submission that gold chain, bracelet, two mobile phones etc. were removed from the possession of the informant during and in course of the incident. Ms. Sahu, learned AGA submits that petitioner No.1 is having 7 to 8 antecedents, whereas, petitioner Nos.3 and 4 are having two each. Considering the overt acts committed by the petitioners in course of events against the informant, this Court is not inclined to consider their plea for pre-arrest bail but allows them liberty to surrender before the learned court below demanding release pleading parity for its
consideration on merit.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, petitioner Nos.1, 3 and 4 surrender before the court of learned S.D.J.M., Dhenkanal in connection with Dhenkanal Town P.S. Case No.54 of 2026 corresponding to G.R. Case No.134 of 2026 within a fortnight from today and move applications for bail, it shall be considered by learned court below and disposed of considering their plea for parity in view of the release of the petitioner No.2 as against whom the ABLAPL has become infructuous. It is further directed that in the event the plea for bail stands rejected, the petitioners shall have the liberty to approach the Sessions Court during the second hour for orders on the same day and for the said purpose, relevant record shall be made available without delay.
6. Issue urgent certified copy of this order as per rules.
