By way of the present application, the applicant is seeking grant of interim bail, in case arising out of FIR bearing no. 657/2004, registered at Police Station Paschim Vihar, Delhi, for the commission of offences punishable under Sections 302/174(A) of the Indian Penal Code, 1860 (hereafter ‘IPC’), on medical grounds. 4. Issue notice. The learned APP accepts notice on behalf of the State. 5. intervention, as has been suffering for a considerable period of time from various chronic and life-threatening ailments, apart from several age-related medical complications. It is further argued on behalf of the applicant that although the applicant's surgery was scheduled for 14.05.2026, the same could not be conducted as the applicant was unfit for the procedure at the relevant time. It is submitted that the applicant now intends to undergo the said surgery at a private hospital. On these grounds, prayer has been made for enlarging the applicant on interim bail. 6. Per contra, learned APP appearing for the State submits that it is undisputed that the applicant's surgery was scheduled for 14.05.2026 and that it could not be conducted. However, it is contended that the applicant is now seeking interim bail for the purpose of scheduling the surgery at a private hospital, despite the fact that no date for the proposed surgery has been fixed till date. It is, therefore, prayed that the present application seeking grant of interim bail be dismissed. 7. This Court has heard arguments addressed by the learned counsel for the applicant and the learned APP for the State and has perused the material available on record, including the medical status report of the applicant. 8. This Court notes that the applicant has been suffering from various medical ailments and has been taken to hospitals on multiple occasions for medical treatment.
It has also been brought to the notice of this Court that the applicant was advised to undergo surgery on 23.04.2026; however, the said surgery was deferred on several occasions and rescheduled for
14.05.2026. However, on 14.05.2026, the proposed surgery could not be performed because the applicant was found medically unfit to undergo it at the relevant time. This is a digitally signed order. 9. This Court further notes that the applicant now intends to undergo surgery at a private hospital and, for that purpose, seeks to be released on interim bail. The factum of the petitioner’s requiring immediate surgical intervention is apparent from the record, however, for one reason or the other while he is confined to jail, surgery could not be conducted. Therefore, this Court deems it appropriate to release him on interim bail for the purpose of undergoing surgery from a private hospital of his choice. 10. Considering the overall facts and circumstances of the case, this Court grants interim bail to the applicant herein for a period of four weeks from the date of his release, on his furnishing personal bond in the sum of Rs. 20,000/- with two sureties of the like amount, subject to the satisfaction of the concerned Jail Superintendent on the following terms and conditions: i) The applicant shall not leave the country without prior permission of the concerned Court and if the applicant has a passport, he shall surrender the same to the concerned Trial Court. ii) In case of change of residential address/contact details, the applicant shall promptly inform the same to the concerned Court and IO/SHO concerned. iii) The applicant shall appear regularly before the learned Trial Court, unless exempted.
iv) The applicant shall not communicate with, or come into contact with the complainant or any of the prosecution witnesses, or tamper with the evidence of the case. 11. Accordingly, the present bail application stands allowed and is
disposed of. Pending application also stands disposed of.
