PATTANAIK Order No. ORDER 08.04.2026 01. 1. Both the ABLAPLs are taken up together and disposed of by the following common order. 2. Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with C.T. Case No.394 of 2025 arising out of Komna P.S. Case No.396 of 2025 pending in the court of learned G.N.A.- Cum- J.M.F.C., Komna on the grounds stated therein. 3. Perused the F.I.R as at Annexure-1. The petitioner in ABLAPL No.1934 of 2026 is the husband of the informant, whereas, the others in ABLAPL No.2167 of 2026 are the family relations of the said accused. It is alleged in the report that the family of the accused, namely, Ajay @Ajay Sunani did not accept the informant as their daughter-in-law and committed such other mischief alleged against them. It is claimed that the petitioner was physically assaulted by the accused persons during an incident, later to which, the FIR was lodged. Considering the nature of allegations and dispute between both the sides and that the FIR reveals that there was argument, fighting and assault caused to the informant after her marriage with the accused husband and the opposition of the other petitioners in accepting her, this Court, recording the objection of the State though not in favour of considering their plea for pre-arrest bail but is of the view that the petitioners should instead be directed to surrender before the learned court below for being released with conditions. 4. In the result, the ABLAPL petitions stand disposed of with a direction to the petitioners to surrender before learned G.N.A.- Cum- J.M.F.C., Komna within three weeks from today and in the event, they surrender in compliance thereof, shall be released on bail in connection with C.T. Case No.394 of 2025 on furnishing a bail bond of Rs.20,000/- (rupees twenty thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, no one shall cause any harm or injury to the informant in any manner whatsoever while on bail and not to commit further mischief with her and to furnish an undertaking at the local P.S. in that regard and at the same time, to cooperate the I.O. in the investigation as and when summoned. 6.
