JUSTICE R.K. PATTANAIK Order No. ORDER 08.04.2026 01. 1. Both the ABLAPLs are taken up together and disposed of by the following common order. 2. Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with G.R. Case No.28 of 2026 arising out of Bhograi P.S. Case No.06 of 2026 pending in the court of learned S.D.J.M., Bhograi on the grounds stated therein. 3. Perused the F.I.R as at Annexure-1. The Court finds that the accused husband is married to the informant since 2021. The allegation in the FIR is that extra dowry was demanded for an amount of Rs.10 lac and for the non- fulfilment of the same, the informant was subjected to mental and physical cruelty. It has been alleged that the informant was assaulted by the accused husband. The allegation of dowry demand is against the petitioners as well but such allegation is omnibus in nature. The incident during which the informant was assaulted and described in the FIR is of the year 2024. In fact, the Court finds that the informant stayed with the accused husband at a place in the State of Tamil Nadu and as informed, presently staying separate. Considering the above facts and the allegation of assault since alleged against the accused husband with a general allegation of dowry demand against the petitioners , recording the submissions of learned counsel for the both the parties, this Court, even if not in favour of entertaining their plea of pre-arrest bail as demanded but is inclined to direct all of them to surrender before the learned court below for being released with stringent conditions imposed. 4. In the result, the ABLAPL petitions stand disposed of with a direction to the petitioners to surrender before learned S.D.J.M., Bhograi within four weeks from today and in the event, they surrender in compliance thereof, shall be released on bail in connection with G.R. Case No.28 of 2026 on furnishing bail bonds of Rs.25,000/- (rupees twenty-five thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, they shall not cause any harm to the informant in any manner whatsoever, while on bail and to cooperate the I.O. in the investigation whenever necessary. It is directed that till the time, the petitioners surrender before the learned court below, they shall not be arrested in connection with the case. 6.
