By way of instant application filed under Section 5 of Limitation Act, prayer has been made on behalf of the applicant/ petitioner for condonation of delay in maintaining the Review Petition, which is barred by limitation. Though by way of filing reply to the application, prayer made on behalf of the applicant/petitioner has been opposed by the non-applicants/respondents-State, but having carefully perused the averments contained in the application, which are duly supported by an affidavit, this Court finds no impediment in accepting the prayer, especially when delay caused in maintaining accompanying Review Petition does not appear to be intentional or willful, rather same has occurred on account of circumstances, which were completely beyond the control of the applicant, as such, the same deserves to be condoned. In view of above, delay, which has been otherwise sufficiently explained, is condoned. The application is disposed of. Review Petition No. _________ of 2026 Be registered. List on 17.03.2026.
