The present petition has been filed by the petitioners under Article 226 of Constitution of India read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) seeking following reliefs: “a. issue a writ of mandamus or writ of any other nature, order(s), direction(s) to the respondents thereby directing the respondent no.1 to 4 to protect the life and liberty of petitioners from the respondent no.5 to 7 along with their associates, who are threatening the petitioners to liquidate them and hence the life and liberty of the petitioners are in jeopardy and also prohibit them from interfering in the life and liberty of petitioners in any manner whatsoever, in the interest of justice. b. Any other or further order(s) which this Hon'ble Court deems fit and proper in the facts and circumstances of the case may also be passed in This is a digitally signed order. Learned counsel for the petitioners submits that the petitioners are tenants under respondent nos. 5 to 7 and that the said respondents, being the landlords, are threatening to falsely implicate them in criminal cases. It is, therefore, prayed that adequate police protection be granted to the petitioners. 4. Learned counsel for the State, who appears on advance notice, submits that the present petition is a clear misuse of the writ jurisdiction of this Court and cannot be invoked to settle a landlord-tenant dispute. He further submits that there is no PCR call record regarding the alleged incident. Though one complaint has been filed by the petitioners, the same nowhere mentions the allegation that respondent no. 5 had torn her own clothes in order to falsely implicate the petitioners, and no such allegation finds mention therein. As regards the prayer for police protection, it is submitted that a civil dispute between the parties is already pending and an eviction petition/suit for possession instituted by the respondents against the petitioners is also pending adjudication before the Civil Court. 5. Heard and perused the record. 6. If the petitioners apprehend any threat to their life or liberty, they are at liberty to avail the remedies available under law by approaching the concerned Police Station and, if so advised, the concerned jurisdictional Magistrate. 7. The extraordinary writ jurisdiction of this Court cannot be invoked in disputes of this nature arising out of a landlord-tenant relationship for the purpose of granting police protection to either of the parties, particularly when the civil dispute between them is already pending adjudication before the This is a digitally signed order.
