1. Heard learned counsel for the respective parties.
2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Nandapur P.S. Case No. 148 of 2025 corresponding to G.R. Case No. 982 of 2025 pending in the file of Learned SDJM, Koraput on the grounds stated therein
3. Recorded the submission of learned counsel for the respective parties. It is informed to the Court by learned counsel for the petitioners that the main assailant is one Ratha Golari, who is in custody now. Since the petitioners are on a better footing and did not cause the fatal injury to the deceased but the co-accused named above, all of them should be directed to surrender and to go on bail with any conditions. Recorded the objection of Mr. Brahma, learned ASC for the State, who
seriously opposed the plea of bail of the petitioners in view of the nature of allegations in the F.I.R.
4. The names of the petitioners are mentioned in the F.I.R. with the other accused, who said to have caused the fatal injury. It is informed to the Court that the co-accused persons, namely, Sukra Golari, Budu Golari, Mangala Dora, Bhusan Dora and Balaram Dora have been released on bail after their arrest. It is claimed that the petitioners are similarly situated like the said accused persons and hence, parity should be extended directing them to surrender for being released with suitable conditions imposed. The Court recording the submission as above is not inclined to entertain the bail plea, however, grants the liberty to all to surrender before the court below seeking regular bail.
5. Accordingly, it is ordered.
6. In the result, ABLAPL is disposed of. It is further
directed that in the event, the petitioners surrender within a period of fifteen days from today before the learned SDJM, Koraput in connection with Nandapur P.S. Case No. 148 of 2025 corresponding to G.R. Case No. 982 of 2025 and move applications for regular bail, it shall be duly considered in the first hour and in case of rejection, they shall approach the learned Sessions Court during the second hour for orders on the same day followed by a decision on merit and for the said purpose, the lower court case record shall be made available. It is also directed that the plea of parity shall be considered by the
learned courts below while dealing with the bail application of the petitioners.
