Nadim Seraj, learned Advocate for the Bihar School Examination Board. 2. The grievance of the petitioners is in a limited bound to the extent whereby the petitioner seeking a direction upon the Secretary, Bihar School Examination Board to upload his marks of intermediate, bearing Roll Code 5210, Roll No. 40024, Enlistment No. R-03131/03 pertaining to annual intermediate Science Examination, 2006 on Data Management System-2. Learned Advocate for the petitioner submitted that in absence of such uploading, petitioner is facing hurdle for permanent registration in the Delhi Medical Council as well as in public employment under Government. The facts are not disputed that the petitioner had appeared in the intermediate examination in the year 2005, duly held by the then Bihar Intermediate Education Council, Patna and he had successfully passed the examination with second division. Out of 900 marks, the petitioner secured 455 marks in the intermediate examination, 2005. On being dissatisfied with the marks obtained as referred herein above, the petitioner appeared in the Intermediate Improvement Examination to be held in the year 2006 and out of 900 marks, this time the petitioner secured 499 marks. Despite the fact that the petitioner secured 499 marks, the necessary correction in the marks uploaded in the website of Bihar School Examination Board has not been corrected, compelling the petitioner to approach before this Court. 4. A supplementary affidavit has been filed on behalf of the petitioner and it is specifically submitted that the Board vide Memo No. 195 dated 06.12.2022 constituted a sub- committee for consideration and resolution of complicated cases. The Sub Committee convened its meeting on 06.05.2026 and categorically found that there had been an increase of 10 marks in English subject and accordingly uploaded the same Patna High Court CWJC No.1930 of 2026 dt.20-07-2026 3/3 after making necessary correction, but surprisingly this time again they left the marks of Biology, which had been increased from 93 to 143. On account of such mistake, the correct marks of the Biology could not be uploaded on Data Management System 2, though the Board has admitted that the petitioner has secured 499 marks out of 900. 5. Considering the fact that once the Board has admitted that the petitioner has passed the Intermediate Improvement Examination with second division by securing 499 marks with an improvement of marks in English as well as in Biology, this Court does not find any reason not to upload the marks of Biology in Data Management System 2. Accordingly, this Court directs the Secretary and the Examination Controller of the Bihar School Examination Board to consider the claim of the petitioner and get the marks of Biology uploaded in Data Management System 2, preferably within a period of two weeks from the date of receipt/production of a copy of this Order. 6.
