By virtue of the present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of anticipatory bail in proceedings arising out of FIR No.836/2025 dated 15.12.2025 registered at PS: Mukherjee Nagar under Sections 109(1)/190/ 191(2)/191(3)/3(5) of the Bharatiya Nyaya Sanhita, 2023. 2. Succinctly put, as per prosecution the applicant alongwith certain other persons, while they were in an intoxicated condition, picked a quarrel with the complainant and his brother at Down Town Restaurant in Mukherjee Nagar as also attempted to confine them inside the said restaurant. Then, when the complainant and his brother escaped from the said restaurant, the said persons followed them and assaulted the brother of the complainant with a knife, inflicting several stab wounds in his abdomen and hand. In this backdrop, this Court has heard learned counsel for the applicant as also learned APP, and also considered the materials on record. 4. As borne out, this is a case involving serious offences of the complainant and his brother being chased and assaulted repeatedly by the applicant and other co-accused persons, which is clear from the CCTV footages recovered. In fact, as per the Status Report, the applicant is seen following the complainant as also his brother outside the PG of the complainant and his brother. 5. Interestingly, the present FIR has been registered while the applicant was out on regular bail in a previous FIR bearing No.295/2023 under the analogous Sections 307/34 of the Indian Penal Code, 1860. 6. Considering the aforesaid, especially, the registration of this subsequent FIR whence the applicant was out on bail, there is a suspicion of his committing further offences when/ if granted bail as his conduct does not behove any confidence in this Court. There is, thus, no reason for this Court to grant an anticipatory bail to the applicant in such a scenario. 7. The present application is accordingly dismissed. 8. Needless to say, expression of view(s) on merits, if any, is solely for the purposes of adjudication of the present application and shall have no bearing on the overall proceedings involved.
