CMP(M) No. 190 of 2026 By way of present application filed under Order 22, Rules 3 and 9 of the Code of Civil Procedure read with Section 5 of the Limitation Act, a prayer has been made to bring on record the legal representative of deceased petitioner after condoning the delay and setting aside the abatement. The sole petitioner has died on 20.08.2025 and his wife has filed the present application to bring her on record in place of deceased petitioner. Since no reply has been filed by the respondents, despite opportunity being granted to them, the present application is allowed and applicant Vijay Gautam, wife of late Desh Lal Gautam, mentioned in para No. 2 of the application is ordered to be brought on record in place of deceased Desh Lal Gautam, after condoning the delay and setting aside the abatement.
