BEFORE HONOURABLE MR. JUSTICE PRANJAL DAS ORDER 16.07.2026 Heard Mr. S. Islam, learned counsel for the petitioner and Mr. K. K. Parasar, learned Additional Public Prosecutor, Assam.
2. The petitioner, namely, Sanidul Islam is facing trial in connection with Sessions Case No. 62/2023 under Section 366(A) of IPC pending before the court of learned Sessions Judge, Barpeta.
3. It is submitted by the learned counsel for the petitioner that due to default
Page No.# 2/2 in appearance before the learned trial court, NBWA was issued against the petitioner and accordingly, he was arrested and presently in judicial custody.
4. Learned counsel further submits that the petitioner will appear regularly and will co-operate with the trial and abide by any condition imposed if granted bail at this stage.
5. Upon perusing the materials available at this stage, I am of the considered view that the bail petition can be disposed of today by granting bail to the accused in view of the undertaking made on his behalf.
6. Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.50,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioner: (a) shall be available for the remaining trial. (b) shall not hamper or tamper with the evidence. Violation of bail conditions entails cancellation of bail.
7. Accordingly, this bail application stands allowed and disposed of.
