Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Bansada P.S. Case No.14 of 2026 corresponding to Special Case No.15 of 2026 pending in the court of learned Additional District & Sessions Judge-cum-Special Court under POCSO Act, Bhadrak on the grounds stated. 3. Gone through the FIR as at Annexure-1. It is submitted to the Court that the principal accused has absconded. The allegation of sexual mischief is against the principal accused, whereas, the petitioners are his family members and they have been alleged of having committed the overt acts during an incident after the mischief was committed with the victim, namely, daughter of the informant. It is informed to the Court that the principal accused has not been arrested as yet. Recorded the objection of the State. It is further informed to the Court that petitioner No.2 was arrested in connection with the case and has been released on bail in the meantime. In such view of the matter and considering the nature of allegations as per Annexure-1 and submissions of learned counsel for the respective parties that the other petitioners are the family members of the principal accused unconnected to the act of sexual mischief, this Court, though not in favour of granting pre-arrest bail to any of them but is of the view that all except petitioner No.2 should be directed to surrender before the learned Special Court for being released with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL petition stands disposed of with a direction to petitioner No.1 and petitioner Nos.3 to 7 to surrender before learned Additional District & Sessions Judge- cum-Special Court under POCSO Act, Bhadrak within a fortnight from today and in the event, they surrender in compliance thereof, shall be released on bail in connection with Special Case No.15 of 2026 on furnishing bail bonds of Rs.20,000/- (rupees twenty thousand) each with one solvent surety for the like amount each to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. As regards, the bail plea of petitioner No.2, namely, Rajendra Samal the ABLAPL stands dismissed as being infructuous for the reason stated above. 6.
