This application is filed to condone the delay of 1059 days in filing the appeal, which is very excessive and abnormal.
Mr.B.Rama Shankar Rao, learned counsel for the appellant, has taken the Court to the reasons indicated in the affidavit filed in support of the delay.
On the other hand, refuting the said allegations, Smt.T.V.Sri Devi, learned counsel for the 3rd respondent, would vehemently contend that the reasons indicated are not cogent and the explanation for the said delay is not forthcoming and requested to dismiss the application.
This Court is of the opinion that the claimants under the Motor Vehicles Act, 1988 are governed by a beneficial peace of legislation and that a liberal approach should be adopted in condoning the delay, as held in National Insurance Company Limited vs. Pranay Sethi1.
Considering the said averments and reasons assigned in support of the delay, this Court is of the opinion that, in the interest of justice, the delay deserves to be condoned, subject to payment of costs of Rs.5,000/- to the
learned counsel for the respondents, within two weeks from the date of this order.
Accordingly, this application is allowed.
