The writ petition has been instituted challenging the show cause notice. No writ against show cause notice is entertainable unless such notice has been issued by an incompetent authority having no jurisdiction or tainted with malafides. Thus, the show cause notice per se would not provide cause for institution of writ proceedings. In the present case, the writ Court has considered the principles and granted liberty to the appellant to submit his explanation in response to the show cause notice. 2. Learned counsel for appellant would submit that reply has already been given and therefore, the authorities have to consider the same and take a final decision. That being the factum, no further adjudication needs to be undertaken. The authorities are directed to proceed with the matter and pass appropriate final orders by following the procedures as contemplated under law. This writ appeal is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S.,J.)
